Toccoa Guide Gear LLC (TGG) warrants to the original retail purchaser of the “Toccoa Rod Box” or “Toccoa Rod Box XL” (to be referred to as “rod boxes”)  that the rod box is and shall remain free of defects, including materials and workmanship, for a period of 1 year from the date of retail purchase.

 

Should the purchaser discover a defect and notify TGG during this 1-year limited warranty period, TGG will, at its sole discretion, do either of the following:

 

• Repair or replace the unit at no additional charge

• Send replacement parts at no cost 

• Refund all or part of the customer's original purchase price

 

This 1 year limited warranty does not cover cosmetic damage or defects caused by normal wear and tear or aging including, but not limited to, scratches, abrasions, oxidation or UV degradation. This 1 year limited warranty does not cover damage caused by collision, disaster, abuse, modification, misuse, overloading, improper installation or any illegal activity.

 

Limited warranty service may be obtained by first emailing to TGG at info@toccoaguidegear.com and describing the problem or perceived defect. TGG may request documentation in order to fully understand the nature of the problem or defect. If a defect or problem is confirmed, TGG will, at its sole discretion, replace, repair, send replacement parts or authorize, along with proof of purchase data, the original shipping container or its equivalent. Unless otherwise authorized, return transportation charges must be prepaid by the purchaser.

 

All express and implied warranties for this product, including the warranties of merchantability and fitness for a particular purpose, are limited in duration to a period of 1 year from the date of purchase. No warranties, whether expressed or implied, will apply after this period.

 

If this product is defective, your sole remedy shall be repair, replacement, or refund as provided above. In no event will TGG or any of its officers, employees, or agents be liable to you for any damages. This includes incidental or consequential damages arising out of the use of or inability to use the rod box, even if TGG has been advised of the possibility of such damages, or for any claim by another party.

 

Under no circumstances, whether for breach of warranty, breach of contract, negligence, or other tort, or any strict liability theory will Toccoa Guide Gear LLC be liable for damages caused by the failure of any third party hardware including, but not limited to, bolts, nuts, spacers, roof racks, cross bars or any other third party hardware that may be used in conjunction with our products. Toccoa Guide Gear LLC is under no circumstances liable for damage to customer goods used in conjunction with our rod boxes or other products.

 

 

 

CAUTION ABOUT PROPER INSTALLATION

 

The buyer is responsible for installing the rod box securely. Installation instructions are published in our website and are printed and shipped with each rod box sold. If you require installation assistance, please consult our Installation page: Link HERE or email us at: Info@toccoaguidegear.com

Please keep in mind that an improperly secured rod box can fall off the car, potentially injuring others or damaging your belongings or other vehicles. Any damage to the rod box caused by improper installation is not covered by our warranty. In addition, the manufacturer is not liable under any circumstances for any loss or damage resulting from the use of a TGG rod box, whether defective or not. Toccoa Guide Gear LLC’s liability is limited to the repair or replacement of a defective rod box according to the warranty terms described under the warranty section of this website.

Toccoa Guide Gear LLC makes no other warranties, expressed or implied about our products. The manufacturer and its owners are not liable for any indirect, incidental or consequential damages resulting from or in connection with the use or inability to use the rod box, even if Toccoa Guide Gear LLC has been advised of the possibility of such damages, or for any claim by another party.
